Uninsured Employers' Fund

The Office of the Attorney General is dedicated to ensuring that no workers' compensation claimant will be unable to receive benefits due to a business' failure to obtain coverage.

The Uninsured Employers' Fund (UEF) branch of the Office of Civil and Environmental Law participates in all workers' compensation cases in which the employer did not have workers' compensation insurance to cover the claim. We participate in claims at all levels from workers' compensation administrative law judges to the Kentucky Supreme Court. We also participate in third-party tort claims in circuit courts, in collection actions undertaken by the Fund and others, and as a creditor in federal bankruptcy proceedings.

If a claimant wins the case and has no other source from which to obtain the income and medical benefits awarded, the benefits are paid by the UEF. The purpose of the UEF is to ensure that no workers' compensation claimant will be unable to receive workers' compensation benefits because of a failure on the part of their employer to obtain workers' compensation insurance.
