In re: Jeannie Burchett/City of Olive Hill

Open Records Decision

This matter having been presented to the Attorney General in an open records appeal, and the Attorney General having considered the relevant facts and law, we find that the City of Olive Hill violated the provisions of KRS 61.870 to 61.884 in denying Jeannie Burchett's request for copies of building permits that were issued from January 1, 1995, to the present. We believe that 97-ORD-42, and the authorities cited therein, are controlling. A copy of 97-ORD-42 is enclosed, and adopted by reference. The City of Olive Hill is directed to immediately arrange for Ms. Burchett to inspect the records identified in her request, or alternatively to provide her with copies upon receipt of payment for same.

A party aggrieved by this decision may appeal it by initiating action in the appropriate circuit court pursuant to KRS 61.880(5) and KRS 61.882. Pursuant to KRS 61.880(3), the Attorney General should be notified of any action in circuit court, but should not be named as a party in that action or in any subsequent proceeding.
