Who may be eligible for restitution under the Dell multi-state settlement?
A claim must meet the following requirements in order to be eligible:
- It must concern a product or service purchased from Dell between April 1, 2005, and April 13, 2009;
AND
- It must be a consumer complaint about
- a Dell Financial Services deferred-interest financing promotion (such as “same as cash” or “no interest for 90 days”) offered to some consumers who qualify for a Dell credit account, or
- a rebate that the consumer applied for but did not receive, or
- warranty service that Dell did not perform as promised or as required by the State’s implied warranty law, or
- extended warranty or next-business-day service that was not provided as promised; AND
- The consumer must have suffered a verifiable out-of-pocket (monetary) loss.
How will I know if I’m eligible?
First you have to complete a claim form and submit it to the Kentucky Attorney General’s Office of Consumer Protection so that it is postmarked by April 13, 2009. Your claim will be reviewed. If you are not eligible, you will be notified and you will be sent a consumer complaint form so that your complaint can be processed through normal channels. If you are eligible you will be mailed a check once all claims have been received and evaluated.
When will checks be issued?
The claim period ends April 13, 2009, and the states will then forward the claims to Dell. Dell will then issue the checks to eligible claimants. It is anticipated that checks will be mailed by June 22, 2009.
I received the claim form and I have questions about how to fill it out.
We cannot give you direct assistance in completing the claim form. We can only ask that you identify the problems you experienced and that you do the best you can to provide specific dollar amounts that you paid out-of-pocket to Dell or in an effort to resolve one or more of the problems that you’ve identified.
I no longer have any invoices statements or documents relating to my problems or purchase. Can I still file a claim?
Yes. We are not going to require you to produce documentation that you do not have in order to file a claim. We may, however, need to work with you and/or Dell to verify your claim and claim amount.
I already filed a consumer complaint with your office against Dell. Do I need to also file a claim?
Yes. If you filed your complaint recently, we sent you a claim form if your complaint was not resolved or if we reviewed your complaint and believe that the issues in your complaint may make you eligible for restitution.
