Uninsured Employers' Fund
Ensuring that no workers' compensation claimant will be unable to receive benefits due to business's failure to obtain coverage
The Uninsured Employers' Fund branch of the Civil and Environmental Law Division participates in all workers' compensation cases in which the employer did not have workers' compensation insurance to cover the claim. We participate in claims at all levels from workers' compensation administrative law judges to the Kentucky Supreme Court. We also participate in third-party tort claims in circuit courts, in collection actions undertaken by the Fund and others, and as a creditor in federal bankruptcy proceedings. If a claimant wins the case and has no other source from which to obtain the income and medical benefits awarded, the benefits are paid by the UEF. The purpose of the UEF is to ensure that no workers' compensation claimant will be unable to receive workers' compensation benefits because of a failure of the employer to obtain workers' compensation insurance.
