Kentucky: Office of the Attorney General - Calculating Child Support Obligations

Dad with girls In Kentucky, child support obligations are established and/or modified using a statutorily established set of guidelines. According to KRS 403.211, obligations are to be set in accordance with the guidelines table unless extraordinary circumstances exist. Extraordinary situations are to be handled at the discretion of the court.

To determine the amount of a child support obligation, Kentucky uses a worksheet, based on the guidelines, to calculate the proposed obligation. The worksheet (42kb PDF) uses the income of both the custodial parent and the noncustodial parent and considers other factors such as medical insurance, maintenance payments, child care, and support for prior born children.

Once an obligation has been established, it can be modified. However, there are certain criteria. As set out in KRS 403.213, the obligation must reflect a 15% change in order to be modified.

KY's guidelines are reviewed at least every four years by the Child Support Guidelines Commission as prescribed in KRS 403.213(4).
