Attorney General Stumbo Files Suit against Frankfort Health Spa

FRANKFORT, KY (March 23, 2005) - Attorney General Greg Stumbo announced today the filing of a lawsuit yesterday in Franklin Circuit Court against a Frankfort health spa, Fast Acceleration Sports Training LLC, doing business as “Fitness Planet” or “Planet Fitness,” along with its owner, Dwayne Carr.

The spa, located in the Frankfort Place Shopping Center at 193 Versailles Road, Frankfort, had begun operations without complying with the requirements for registration with the Attorney General, including full disclosure of required information and the posting of a surety bond or other consumer protection measures.

A temporary restraining order was signed which prohibits the Defendants from operating a health spa or selling memberships until registration is correct, complete and accepted by the Attorney General.

“Consumers are placed at risk by health spa operators who ignore the requirements for operation,” said Attorney General Stumbo. “It is also unfair to the health spa owners who play by the rules to allow some facilities to ignore the law.”
