Attorney General Stumbo Supports Supreme Court Decision to Review Daimler Chrysler Case

FRANKFORT, KY (September 27, 2005) – Today Attorney General Stumbo announced that he is pleased with the Supreme Court decision to review a Sixth Circuit case striking down state tax credits designed to attract new business investment (Daimler Chrysler Corp v. Cuno 04-1704; Wilkins v. Cuno 04-1724.) At issue is whether this practice violates the dormant Commerce Clause when the amount of the credit is based on the business’s new investment in the state.

“I have worked hard to ensure that businesses will have an opportunity to grow in Kentucky,” Stumbo said. “Economic development is a high priority of my Office. Only by aggressively defending Kentucky’s laws can we encourage the creation of more good jobs for Kentuckians.”

The Office of the Attorney General will now present its legal arguments to the Supreme Court in a formal brief.
